1. Parties and scope
These terms govern the relationship between MONETA Tanıtım Organizasyon Reklamcılık Yayıncılık Tic. Ltd. Şti. (“MONETA”) and any company or person (“Customer”) purchasing publication packages, sponsored content, web banners, print advertising or add-on services via monetatanitim.com. If the Customer is a consumer, the Pre-contract Information Form and the Distance Service Sales Contract also apply; in case of conflict, the provision more favourable to the consumer prevails.
2. Ordering process
- Selection: choose a ready-made package or portals, magazines, banners and quantities in the package builder. Prices are calculated on the server from the current price list; VAT is shown separately.
- Review and correction: before ordering, the summary shows all selections, publication rights and the total; any step can be corrected with “Back”.
- Order: enter billing details, accept the relevant texts and choose “Place the order”. The order number is shown on screen and sent by email.
- Invoice: MONETA prepares the invoice or proforma and shares it in the client portal and by email.
- Payment: after the invoice is shared, pay by card (iyzico, 3D Secure) or bank transfer. Card details are never sent to or stored by MONETA.
- Performance: once payment is confirmed, publication rights appear in the client portal; content is published on the planned dates after editorial approval.
The order record, the accepted text version and the invoice are stored in the client portal for the contract term and the statutory retention periods.
3. Prices
Prices are in Turkish lira excluding VAT; VAT is shown separately in the summary and on the invoice. The price list version in force at the time of the order is recorded with the order; later price changes do not affect placed orders. Items marked “on request” are priced by written quotation.
4. Payment
Payment is made after the invoice or proforma is shared. Upfront orders are paid in full; monthly plans are paid per period with that period’s invoice. Monthly payment does not change the contract term. Rights for an unpaid period are not activated.
5. Publication rights and unused rights
- Publishing one piece of content once on one site is one publication right (e.g. the same content on 3 portals = 3 rights).
- Packages: rights unused in a month roll over until the end of the package term and then expire. If the package is renewed without interruption for the same company, remaining rights are carried over once into the new term.
- One-off and multi-content purchases: rights are valid for 12 months from payment.
- Each right’s expiry date is shown in the client portal and a reminder is emailed 30 and 7 days before expiry.
- Rights cannot be transferred to another company; agency accounts may use them across the agency’s own client brands.
- Rights for content that cannot be published for reasons attributable to MONETA, or that MONETA rejects, are restored.
6. Content rules and advertising disclosure
The Customer warrants that it holds the rights to the text, images and links it submits and that they are accurate and lawful. MONETA may request revisions or reject content that breaches a site’s published rules, editorial principles or the law. Advertising content is published with a “Sponsored” label so as not to constitute covert advertising; paid links carry rel="sponsored".
7. Print advertising
Materials must be delivered by the issue’s material deadline and meet the magazine’s technical specifications. If materials are late or non-compliant, MONETA may move the advert to the next issue after informing the Customer.
8. No guarantees and liability
MONETA does not guarantee any reach, readership, clicks, search ranking, link type or sales result. Publication dates are planned dates; short delays due to force majeure or technical reasons do not cause loss of rights. Towards business customers, MONETA’s liability is limited to the price of the relevant order, except for intent and gross negligence.
9. Cancellation and refunds
See the Cancellation and Refund Policy.
10. Personal data and communications
Personal data is processed in line with the Privacy Notice. Commercial electronic messages are sent only with separate consent or where the law permits; you can opt out free of charge in every message.
11. Intellectual property and licence
For content and images submitted for publication, the Customer grants MONETA a perpetual, non-exclusive, royalty-free licence to use, reproduce and distribute them on the ordered portals and magazines, their archives, newsletters and social media accounts. The sites, magazines, logos, designs and software belong to MONETA.
12. Confidentiality
The parties keep non-public business information learned in the course of the order confidential during the contract and for two years after it ends, subject to legal obligations.
13. Force majeure
Obligations are suspended during events beyond the parties’ control (natural disaster, epidemic, war, strike, cyber attack, infrastructure or power failure, public authority decisions). If force majeure lasts over 60 days, either party may terminate with a refund for unused rights.
14. Termination (business customers)
If a party materially breaches its obligations and fails to remedy within 15 days of written notice, the other party may terminate. Unpaid invoices, submitting unlawful content and abuse are material breaches. Refunds and charges follow the Cancellation and Refund Policy.
15. Notices and evidence
Notices are sent to the email addresses given in the order and via the client portal. The parties agree that MONETA’s order, acceptance, payment and publication records (including server and email logs) constitute conclusive evidence under Article 193 of the Turkish Code of Civil Procedure, subject to counter-evidence. For consumers this applies without prejudice to statutory rights of proof.
16. Severability
If any provision is invalid, the remaining provisions remain in force.
17. Changes and disputes
MONETA may update these terms for the future; placed orders are governed by the version accepted at the time of ordering. Disputes with business customers are governed by Turkish law and the Istanbul Anatolian Courts and Enforcement Offices have jurisdiction, subject to mandatory mediation rules. Statutory rules for consumers are reserved.
